Course Description:

If you attend only one seminar this year, it has to be Section 504.

In one short day, you will gain new insight to regulations, laws and issues that significantly affect your K-12 district compliance. Join Dr. John McCook as he draws from his extensive background in teaching and administration, which allows him to speak from a position of experience and not just theory and law. Learn how to provide what the law requires and how to meet these requirements without placing your institution in legal jeopardy.

Questions that will be answered include:

  • How have the ADA Amendments and new federal regulations changed the eligibility criteria under Section 504? What is the school district’s obligation to identify and evaluate students? Are you under or over identifying?
  • Why a health plan can’t substitute for a 504 plan.
  • What are the new rules regarding service animals?
  • What are the “Child Find” obligations under Section 504? How do they compare with those under IDEA?
  • How are discipline and behavioral issues handled with a student eligible under Section 504, as compared/contrasted with a student eligible under IDEA?

Objectives:
  1. Compare Section 504 to IDEA & ADA.
  2. Explain child find obligations under Section 504.
  3. Develop an accommodation plan.
  4. Describe the implications of NCLB as it relates to Section 504.
  5. Identify when and how to make accommodations for behavior issues to be in compliance with Section 504.
  6. Recognize the difference between accommodations and modifications.

JOHN E MCCOOK, EDD

Dr. John E. McCook, served as a consultant for school districts across the nation and has developed training programs for school districts on special education and Section 504. He has authored a book entitled The Administrator’s Guide to Discipline in IDEA and Section 504. In addition, he develops manuals for the practitioner on special education and Section 504.

Dr. McCook is the past director of Special Education and Pupil Personnel for the Knox County School District in Knoxville, Tennessee where he served as the district’s Section 504 Compliance Officer and is certified as a Rule 31 Mediator. During his time as director, Dr. McCook was able to reduce the number of special education students in his district from 11,605 to 8,279 by properly classifying them.

Dr. McCook is often used by legal firms to review cases and student files prior to litigation decisions. He regularly works with the Office for Civil Rights and has represented school districts in Section 504 and IDEA due process cases. As a frequent instructor on all aspects of education and special education law throughout the United States, he is well-respected. His presentations at national meetings, including the National School Board Association and the National Legal Conference for LRP, have won him acclaim and recognition in several publications regarding school legal issues and special education.
