Course Description:

Without the proper legal awareness needed to stay in compliance, you may face grave legal and financial consequences. This seminar will show you how to continue to help the people you’ve been trained to help while still protecting yourself from many legal pitfalls.

Join attorney Elizabeth Guzman for an entertaining and enlightening day and leave with a greater understanding of the latest North Carolina law as it relates to mental health. You will take home practical strategies to minimize and manage legal and ethical risks and you will learn how to immediately implement these risk reducing strategies into your practice.

Objectives:
  1. Discuss access to patient records relating to confidentiality and HIPAA.
  2. Identify the rights of minors in mental health treatment and legal determinations.
  3. Describe the role of the mental health professional in the commitment process.
  4. Develop policies on ethical issues such as restraints, seclusions and informed consent.
  5. Explain when one has a legal duty to warn and whom one should warn.
  6. Describe the process for responding to subpoenas and court orders for mental health records and how to respond in the courtroom.

ELIZABETH GUZMAN, JD

Elizabeth Guzman, J.D., assistant attorney general for Broughton Hospital, conducts weekly commitment hearings and other legal issues for the staff. She also provides legal support and counsel to other Department of Health and Human Services (DHHS) facilities in Western North Carolina. Ms. Guzman provides training on commitment issues for Crisis Intervention Teams in regional law enforcement agencies, and has presented legal seminars.

She received her J.D. degree from the University of Florida College of Law, and she began her legal career as an assistant state attorney in Florida. After leaving the State Attorney’s Office she entered private practice as a litigator in collections law and personal injury. Ms. Guzman became a member of the North Carolina Bar over 20 years ago and continued practice in civil litigation and real estate.
